Nicole Kettwick gets Client’s Driving License Rescinded after Implied Consent Revocation
The City of Coon Rapids charged Nicole’s client with Third Degree DWI (a gross misdemeanor) after an officer pulled her over for making a wide turn and swerving. Nicole’s client told the officer that she had taken a prescription medication. The officer took a blood sample from Nicole’s client and the results confirmed that she did have a controlled substance in her system. Nicole got a copy of her client’s prescription and got the DWI dismissed in the criminal court. However, Nicole’s client still had to fight the DWI going on her driving record. At this hearing, the district court revoked the client’s driver’s license after ruling that the “prescription drug defense” did not apply in the separate Implied Consent proceeding. Nicole appealed that ruling. After Nicole submitted an appellate brief on behalf of her client, the Attorney General’s office administratively rescinded her client’s license meaning that Nicole’s client got her full driving privileges back and they took the DWI off her driving record permanently.
