Through this effort, Dani was able to resubmit her client’s FFL license paperwork and get it approved for her client, so he can continue to possess firearms.

Result: Dani Peden’s client was charged with possession of a pistol without a permit in Hennepin County after being stopped for a minor traffic offense. After reviewing the evidence and examining the legal issues in the case, Dani was prepared to challenge the seizure of her client’s car. Dani reached out to the prosecutor about a possible resolution. Dani highlighted her client’s lack of criminal history and discussed possible evidentiary issues with the prosecutor. Based on their discussions, Dani was able to get the prosecutor to agree to a Stay of Adjudication for the possession of a pistol without a permit charge. This means that Dani’s client does have a criminal conviction for this charge and If Dani’s client follows the conditions set forth by the Court, after 1 year, the remaining charge will be dismissed.

Dani reviewed her client’s sentencing order and determined the Sheriff was incorrect to deny the permit to carry. Dani sent the Sheriff’s Office a letter which outlined the legal reasons the Sheriff was incorrect to deny the permit. Based on Dani’s letter, her client was able to obtain a permit to carry.
