      Felony Assault Charge Dropped to a Disorderly Conduct

With her client’s clean criminal history and numerous witnesses supporting her client and his version of events, Nicole was able to negotiate effectively with the prosecutor on his case. Ultimately, the prosecutor dismissed the charge against her client.

      Result: After Dani’s client got into a fight while drinking at a bar and fled the scene, he faced felony fleeing, gross misdemeanor DWI, and misdemeanor assault charges, and his vehicle was seized by the State. Dani was able to successfully argue for her client’s vehicle back from the State. Then, with her client’s proactive steps, she was able to negotiate a stay of adjudication on the felony fleeing charge, meaning the charge will be dismissed after her client successfully completes probation. This resolution allowed the client to avoid not only a felony conviction, but also jail time.

Based on Dani’s negotiations with the prosecutor and her client’s proactive steps, Dani was able to secure a downward dispositional departure with no prison time. This means that even though the charges carried a presumptive prison sentence of 21 months, Dani’s client will avoid spending any time in prison as long as they follow the terms of their probation.

As trial approached, Mike was able to negotiate a favorable resolution for the client that would not risk the client being deported. Mike’s client received a Continuance for Dismissal on both charges. As a result, Mike’s client was placed on probation for 2 years. Upon successful completion of probation, the charges against Mike’s client will be dismissed automatically.
