Case: Third Degree Criminal Sexual Conduct (x2)
Attorney: Michael J. Brandt
Result: Mike’s client was facing two counts of Felony Third Degree Criminal Sexual Conduct (which could have been charged as a more serious First Degree charge). Based on Mike’s negotiations with the prosecutor and his client’s proactive steps, Mike was able to negotiate a plea agreement that allowed Mike to argue for a gross misdemeanor sentence, hopefully avoiding a felony for his client. After filing a motion and a memo asking the judge to sentence the case as a gross misdemeanor, and making oral arguments at the sentencing hearing, Mike convinced the judge to agree to a downward durational departure. This means that the client received a gross misdemeanor (rather than a felony) level sentence. Mike’s client was placed on probation for two years.
