Nicole Kettwick’s client was charged with two counts of Domestic Assault and one count of Disorderly Conduct for an incident that occurred in Crystal, MN. Nicole’s client’s girlfriend called the police after an argument broke out. When the police arrived they found that the caller was reliable and her face was red and she was crying. There were red marks in the shape of fingermarks on her face that extended over her left ear and at the tip of the fingermarks were white spots that appeared to be similar to blisters and her glasses were broken. After police talked to her further she told them that Nicole’s client became angry and held a BB gun up to her head telling her that the gun could cause brain damage and she thought he was going to kill her. She also indicated she had medical records indicating she had a broken eardrum.
Nicole and her office conducted an independent investigation and took a statement from witnesses in preparation for court. Despite the Prosecutor’s evidence and medical records regarding injuries, Nicole was able to convince the Prosecutor to give her client a chance to keep a conviction off his record and they negotiated a stay of adjudication on one count and the remaining two charges were dismissed. He was placed on probation for two years. If he complies with the conditions, the charges will be dismissed in two years.
