Mike’s client got a special Valentines Day gift — he was acquitted of fourth degree driving while impaired charges by a jury in Sherburne County. Mike’s client was accused of driving his truck from a bar and getting it stuck in a ditch on a snowy night. Mike’s client denied driving and testified that his girlfriend was driving the truck.
An independent witness who lived nearby testified that they saw a man behind the wheel and saw Mike’s client get out of the truck. Two police officers also testified that they saw Mike’s client behind the wheel and that he admitted to driving. Mike impeach the testimony of the witnesses by showing that it was mixed cleanly snowy night with very poor visibility and that the witnesses were mistaken in what they thought they saw. The jury deliberated for approximately 1/2 hours before finding Mike’s client not guilty of two charges of driving while impaired.
