Nicole’s client was charged with Criminal Sexual Conduct in the Second Degree after he was accused of inappropriately touching a child family member. This is a felony which is punishable by up to 25 years in prison and a fine of $35,000.00. Fortunately, Nicole hired a private investigator, had a forensic polygraph examination conducted and prepared the case for a Jury Trial. Ultimately, Nicole was able to negotiate with the Prosecutor whereby her client was granted a Stay of Adjudication, meaning that her client will never be convicted of this offense as long as he successfully completes probation. Because Nicole’s client will never be convicted of this crime he is not required to register as a sex offender.
