Nicole’s client was in the middle of a divorce with his ex-wife. Her client was alleged to have sent her 14 text messages after a court ordered no contact between he and his ex-wife through a harassment restraining order. In order to convict him of violating this order, the State is required to prove her client knew about the order. Nicole determined there was a problem with service of the document and brought that to the prosecutor’s attention. On the morning of trial, the prosecutor agreed with Nicole and agreed to continue both charges of violating a harassment restraining order for dismissal, which means that the case was continued out for a period of time, at which time the charge will be dismissed.
Once the charge is dismissed, Nicole’s client will have the ability to have the record expunged (sealed), which will prevent anyone from knowing that he was charged with the offense.
