Minnesota Governor Tim Walz just signed the legislature’s HF100 bill legalizing the recreational use of marijuana in Minnesota.
Beginning August 1, adults over the age of 21 may possess up to two ounces of cannabis flower in a public place, and up to two pounds of cannabis flower in an individual’s private residence. One may possess up to eight grams of cannabis concentrate.
Individuals over the age of 21 are permitted to use cannabis products in their private residence, on their private property, or on the premises of an establishment or event licensed to permit on-site consumption.
Although this new legislation is progressive, there are various limitations to the use of cannabis. Primarily, an individual under the age of 21 may not use, possess, or transport cannabis. Secondly, one may not use cannabis in a motor vehicle. Furthermore, one may not use cannabis at any location where smoking is prohibited. One also may not use cannabis in a public school; this cannabis use includes lower-potency hemp edibles or hemp-derived consumer products. Further, one may not operate a motor vehicle while under the influence of cannabis. Lastly, one may not smoke cannabis (including a vaporizer) in any location where the smoke or vapor would be inhaled by a minor.
If you wish to grow your own cannabis plants at home, one may only have up to eight cannabis plants, with no more than four plants being mature at any given time. No person may sell cannabis without a license. Also included in this bill was the automatic expungement of certain cannabis offenses.
It is imperative to know that the bill legalizing the recreational use of marijuana does not go into effect until August 1, 2023.
