Mike Brandt succeeded in getting the charges dismissed against his client for Leaving the Scene of a Property Damage Accident. His client had been charged with hitting a trailer in the roadway and leaving his vehicle in the roadway without notifying the owner. The police investigated the case and took a statement over the phone from Mike’s client—notwithstanding the fact that Mike’s client told the officer that he had an attorney.
Mike brought a motion in Court to suppress the statement (or have the statement thrown out) because the client told the officer he had an attorney yet the officer continued with taking a statement from the client. The Judge in the case agreed with Mike and suppressed the statement. Because the statement was suppressed, the State did not have sufficient evidence to prosecute Mike’s client and dismissed the charges.
