After an incident involving a neighbor, Nicole’s client found himself facing a felony charge of Criminal Sexual Conduct in the Third Degree. This felony sentence could have resulted in a felony sentence with 36 months of prison hanging over his head and up to 15 years of probation. Nicole filed a motion for a downward departure ask the Court to sentence her client to a Gross Misdemeanor. Nicole went above and beyond providing the court with a packet of information demonstrating her client’s character, and support from their family, and conducted her own investigation, including interviewing the victim. The judge granted Nicole’s request to sentence the client to a Gross Misdemeanor. Nicole’s client received only 45 days in jail and a two-year probation. According to the Minnesota Sentencing Guidelines in the State of Minnesota, only one out the previous 91 similar cases obtained this result.
